By using this website and by participating in Flying Air Club Inc. activities, you agree to the following terms and conditions. If you do not agree to these terms and conditions, you will withhold from participating in our activities. Changes to these terms and conditions may occur.

 

1. ADMISSION / PARTICIPATION REQUIREMENTS

1. Admission is subject to availability. Early application and payment is advised. Students may have a longer than originally anticipated course duration incurring extra costs for any changes or additional training required for which the student will be responsible.

Progression at the end of any course or program is dependent on successfully passing all courses with the minimum pass percentage prescribed for the course. The pass percentage of each course will be briefed in the orientation program.

 

Once the student has commenced the course or program, if:

The school’s ability to deliver programs or other services in accordance with the descriptions provided is compromised by circumstances beyond the control of the school (e.g., third party industrial action or an act of god), the school will use all reasonable endeavors to minimize disruption as far as it is practical to do so;

3. The Program is cancelled or substantially varied from that described in the prospectus for reasons other than circumstances beyond the institution’s reasonable control, the school will use reasonable endeavors to provide a suitable replacement program, but cannot guarantee to do so. If the student does not wish to accept the replacement program, the student shall be entitled to withdraw from the program. In the event of such withdrawal the school shall make an appropriate refund of fees. Depending on the point at which the withdrawal takes place, the school reserves the

right to retain fees or charges to cover the tuition or services which the student has actually received.

4. The School reserves the right to change or amend any or all of these refund procedures without any prior notice.

5. When a student submits any material via application, email, letter and other media, including any text, photographs and all content, the student, unless Flying Air Club Inc advises otherwise, licenses and grants Flying Air Club Inc its affiliates, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display such Content for any purpose in any media, without compensation, restriction on use, attribution or liability. Student agrees not to assert any moral rights in relation to such use and warrant that they have the full authority to grant these rights.

6. The school authorities, may due to very low attendance making it unviable for the School to continue, cancel classes. The school reserves the right to amend, where necessary, fees and dates of courses. The school prospectus is subject to alteration without prior notice. In case of course cancellation, the student can only make refund request if the school has failed to offer an alternative course.

7. No Student can Copy / Record / Imprint / Take picture of any Instructor, ground class, or Instruction material in any way even while attending classes online.

8. You may be asked to provide your weight, height, age, prior flight training information, any medical conditions that may affect your ability to safely participate in our activities, and any other information that is requested by us when applying for any activity with Flying Air Club Inc.

9. When participating in Flying Air Club Inc activities, you must have a blood alcohol concentration of zero percent (0.00%) and must not be under the influence of any non-prescription drugs. You must inform the instructor of any medications you are currently taking or any medical or physical conditions you have that may affect your ability to safely fly and coordinate yourself. • You may be asked to provide valid photo identification such as a driver’s license or a passport. • You must be proficient in the English language if you wish to undertake

flight lessons. • You must follow any rules or conditions introduced or communicated by Flying Air Club Inc. • We expect you to arrive at least ten (10) minutes early for any of your appointment bookings. • You and anyone who accompanies you must not engage in reckless, foolish, or negligent behavior, or any other behavior that may create risk of injury to you or a third party, while on the premise or participating in our activities. • You must read and accept the risk warning detailed further in section 7 of the terms and conditions. • You must respect all staff, instructors, and fellow students and respect all property, equipment, and facilities. • We are not liable for any damages or losses to any of your personal belongings that you keep unattended on the premises. • You must wear suitable clothing at all times.

2. Inclusions

• The Flying Air Club Inc Membership Program provides dual flying lessons per month in the Foxbat A22 and complimentary landing fees (If Applicable) • Free Pre and Post Briefings before and after flight up to 10 mins in total are included in package. Any additional briefings or flying time will incur additional costs at the $85/ hr or Flying Air Club Inc’s current rates. • All students are entitled to include Books, Headset Usage while flying and unlimited ground school classes on complimentary basis. You can bring in your own headset while flying with a pre-approval from Instructor. Students are liable for any damage to plane because of their personal Headset use on flight.

• Any Kind of Surcharge included in fee.

• Free Use of Hangar Facilities while attending classes / Flying.

3. Payments • In the event that direct debit payment is dishonoured by your financial institution, you will be charged a dishonours fee of $100. • Additional fees may apply for any overdue or late payments. • If there are repeated failures to meet your payment obligations, your packager may be suspended or terminated with written notice to you. You will not be able to redeem any benefits. • You acknowledge and agree that Flying Air Club Inc may change its payment provider and that the current payment provider may, in their sole discretion, assign or novate all existing payment agreements to a new payment provider.

In the event of this occurrence, you consent to Flying Air Club Inc or the current payment provider providing your personal information in accordance with this agreement and Flying Air Club Inc’s privacy policy. • Your membership / Packages or its privileges are not transferrable by you to any other person. Additional aircraft hire or lessons will incur normal Flying Air Club Inc rates. • You acknowledge and agree that all fees are non-refundable upon cancellation. You further acknowledge that failure to use membership services does not affect this condition and that we are not responsible for notifying you for unused services.

The obligation to pay the tuition fees is unconditional. No portion of such fees so paid or outstanding will be refunded or cancelled notwithstanding the subsequent absence, suspension, expulsion, dismissal or withdrawal of the student for any reason.

4. VOUCHERS

• Discovery Flight vouchers can only be redeemed by one person. Multiple vouchers can be purchased as gifts. • Vouchers expire One (1) year from purchase. • If you have completed your first Discovery Flight, any additional flights booked by you will be charged at normal Flying Air Club Inc rates. • While there is no minimum age requirement to begin flying, participants under 18 must have signed parental consent. • You can book your flight appointments seven (7) days a week 9am – 7pm. • Before flying, you will be required to complete a pre-flight booking form with your personal details. You declare that the information you provide to us is true. Your personal details are protected with the Privacy Act. • If your flight is cancelled due to weather, your flight will be rescheduled. We reserve the right to reschedule your flight due to weather conditions or operational considerations. We will attempt to give you the earliest possible notice in the event of a sudden rescheduling. • You are to arrive for your appointment booking at least ten (10) minutes early. If you are late to your flying lesson for more than fifteen (15) minutes, you forfeit your voucher and your booking is cancelled. You will not be refunded. • Bookings are subject to availability. • All vouchers are non-refundable. • No changes are allowed within seventy-two (72) hours of the appointment booking, otherwise a $100 rebooking fee applies.

5. BOOKINGS AND RESCHEDULING

• Booking requests can be done through the bookings process (When Applicable) or thru Sms or Call to allocated instructor.

• Your booking may be rescheduled due to Instructor Availability , operational circumstances or weather conditions. You will be contacted as soon as reasonably possible for your next availability. • You must provide at least seventy-two (72) hours’ notice prior to your appointment booking if you want to reschedule the booking. • You are to arrive for your appointment booking at least ten (10) minutes early. If you are late to your flying lesson for more than fifteen (15) minutes without prior communication with the instructor, you will be considered a no-show. Your booking is cancelled and you will be charged at $85 / Hr

6. REFUNDS AND CANCELLATIONS

• All bookings are non-refundable. Cancellations will not be refunded. • We do not offer refunds for special discount offers or vouchers. • We do not offer refunds for change of mind. • We do not offer refunds if a Visa to stay in Canada is cancelled or unable to be renewed. • You are to arrive for your appointment booking at least ten (10) minutes early. If you are late to your flying lesson for more than fifteen (15) minutes without prior communication with the instructor, you will be considered a no-show. Your booking is cancelled and you will not be refunded.

Students can claim refund incase plane is not flyable consecutively more than 120 days. The refund amount would be decided by management after looking in course utilization by student and this amount cant be challenged by student or his / her parent.

7. RISK WARNING

• While Flying Air Club Inc values safety as its highest priority, you acknowledge and agree that participation by you or your child in any activity with Flying Air Club Inc may expose you to risk. This includes, but is not limited to, the risk of death, personal injury, physical harm, serious injury, psychological, emotional, and mental harm, illness and/or loss or damage to your property from third party participants, pre-existing health conditions, loss of control of an aircraft, collision with objects, property, equipment, engine or aircraft failure, adverse weather conditions, uncontrolled descent or forced landing, misjudgments and any failure to comply with instructions or directions. • You agree, to the extent permitted by law, to release and indemnify Flying Air Club Inc for any loss or damages suffered by you when participating in any of our activities, including any of the acknowledged risks above.

• You agree to give us all relevant personal medical conditions that may affect your ability to participate in our activities without risk. You declare the information you provide Flying Air Club Inc to be true and accurate and not misleading in any way. • You have read this risk warning and are aware of and voluntarily accept any risk that may arise from your or your child’s participation in any activity with Flying Air Club Inc. If applicable, you may have to sign a waiver to formally acknowledge these terms prior to any activity.

8 . Use of Images, Sound & Other Material

Students (and their parents or guardians, where applicable) agree that images, sound, details and achievements of Flying Air Club Inc may be used in any media for promotional purposes without written consent or notification, as long as the images are used to publicize Flying Air Club Inc.

No variation to these conditions is valid unless agreed in writing by the management of the school. Flying Air Club Inc reserves the right to make any addition, amendment or alteration to these conditions upon giving written notice of such change to all affected students.

Please supply Flying Air Club Inc with personal e-mail addresses and mobile telephone numbers prior to course commencement, in order that communication, to include transmission of student reports, may be maintained at all times. Please also advise of any changes as they occur.

9 . Contact Update

It is the student’s responsibility to provide valid and up-to-date contact information for themselves and, when appropriate, their agent. This contact information should include a working e-mail address. The School will assume that any method of communication for which the student has provided contact information, including e-mail, is secure. The school will not be liable for any damages, financial or otherwise, resulting from the release of the student’s personal information to a third party as a result of communication with an invalid or insecure contact point or the interception of communication with said contact point, be it a postal or e-mail address, a telephone or fax number or an SMS.

Each student must arrive at their scheduled lesson prompt, prepared, and in a business-like manner. Students must remain respectful of other students, instructors, and administrators and must conduct oneself in an orderly and considerate manner.

Students will at all times comply with the Aviation Regulations and airport and school rules. Instruction will be given and documentation provided in these rules and regulations, and periodically and appropriately from time to time thereafter.

Failure to comply with this policy in a habitual manner shall be grounds for dismissal from the school.
